USER AGREEMENT

Please read and understand this Agreement before accepting or using our Services.

This User Agreement governs your use of the services provided through domain.com. By completing registration, placing an order, or using any Service, you acknowledge that you have read, understood, and agreed to the terms contained in this Agreement.

1. Definitions

“Customer” / “Buyer” / “You” means the end user purchasing or using the Services.

“Seller” / “We” / “Us” means domain.com.

“Parties” means the Customer and Seller collectively.

“Third-Party Service Provider” means any supplier or third party used to provide or fulfill a Service.

“Service” / “Services” means any service, code, information, or transaction provided through the Seller.

2. Acceptance of Terms

2.1 By registering for an account, placing an order, or using any Service, the Customer confirms that they have read, understood, and accepted this Agreement.

2.2 If the Customer does not agree to these Terms, the Customer must not register for or use the Services.

3. Electronic Communications

3.1 The Customer agrees that this Agreement and other notices, confirmations, invoices, and transaction-related information may be provided electronically.

3.2 The Customer may withdraw consent to electronic communications by contacting the Seller using the contact information provided on the website.

4. Dispute Resolution

4.1 The Parties agree to make reasonable efforts to resolve disputes through mediation before pursuing other available remedies, subject to applicable law.

4.2 Any mediation, arbitration, or court proceeding shall be conducted in the applicable jurisdiction specified by the Seller, to the extent permitted by law.

5. Third-Party Services

5.1 The Seller may use Third-Party Service Providers to fulfill or provide Services. Such Services may also be subject to the terms, conditions, policies, and requirements of those providers.

5.2 The Seller is not responsible for delays, interruptions, changes, or failures caused by a Third-Party Service Provider, except where liability cannot legally be excluded.

6. Changes to These Terms

6.1 The Seller reserves the right to update or modify this Agreement from time to time.

6.2 Updated Terms will become effective when posted on the website unless a different effective date is stated.

7. Privacy

The Seller is committed to protecting Customer information. Personal information will be collected, used, stored, and disclosed in accordance with applicable privacy and data-protection laws and the Seller's Privacy Policy.

8. Failed or Unavailable Transactions

If a Third-Party Service Provider is unable to complete a transaction, the transaction may be marked as “Not Found” or another applicable status. Where the transaction qualifies for a refund or credit, the applicable credit or refund will be issued.

9. Service Failure Claims

If a Service is reported as completed but is not accepted or does not work as represented on the applicable cellular device, the Customer must notify the Seller within 7 calendar days of receiving the Service.

The Seller may request reasonable evidence to investigate the claim, including:

  1. Continuous video proof of the issue.
  2. No unexplained interruptions, cuts, or edits in the recording.
  3. The cellular device must remain visible throughout the recording.
  4. The device IMEI or other identification number must be clearly visible.
  5. The recording must show the Service being entered or applied and the resulting error.
  6. Additional information may be requested where reasonably necessary.

10. Claims That May Be Rejected

Subject to applicable law, a return, refund, replacement, or credit may be denied where one or more of the following applies:

  1. An incorrect IMEI or device identification number was provided.
  2. Required evidence supporting the claim is not provided.
  3. The Customer fails to notify the Seller within the applicable 7-day period.
  4. The device is hard-locked or otherwise prevents the Service from being applied.
  5. The Customer obtains another related Service before the original transaction is resolved.
  6. The device accepts the Service but is incompatible with the intended network.
  7. The device has unrelated internet, Wi-Fi, network, hardware, or software problems.
  8. The device is defective or does not allow the applicable code or Service to be entered.

11. Customer Responsibility

The Customer is responsible for ensuring that all information submitted to the Seller is accurate and complete, including the device model, IMEI, account information, and any other information required to process an order.

12. Intellectual Property

All website content, including text, graphics, software, design, logos, and other materials owned by the Seller, is protected by applicable intellectual property laws.

Third-party trademarks, logos, images, and other intellectual property remain the property of their respective owners.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the Seller will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the Services.

Important: Nothing in this Agreement excludes or limits any liability, right, or remedy that cannot legally be excluded or limited under applicable law.

14. Compliance With Applicable Law

The Customer agrees to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.

15. Copyright / DMCA

The Seller respects intellectual-property rights and will respond to valid copyright notices in accordance with applicable law, including the Digital Millennium Copyright Act (DMCA), where applicable.

16. Customer Acceptance

By completing registration, placing an order, clicking “I Agree,” or using the Services, the Customer confirms that:

  • They have read this Agreement.
  • They understand its terms.
  • They agree to be bound by the applicable terms.
  • They have had an opportunity to seek independent legal advice where appropriate.

If the Customer does not agree with this Agreement, the Customer should not complete registration, place an order, or use the Services.
